Introduction to the terms of use
Our e-commerce store welcomes you. Below you will find the terms and conditions governing your use of this store and all legal consequences arising from your use of the store’s services over the internet through this electronic platform. Anyone who uses the store—whether as a consumer of a service or product or otherwise—is deemed to have accepted these terms with full legal capacity under Sharia, regulations, and law, and to be bound by all provisions hereof. This agreement applies to all dealings between the consumer and the store. It is effective upon your acceptance and when you begin registration with the store in accordance with Article 10 of the Saudi Electronic Transactions Law.
Article 1 – Introductory definitions
The introduction above forms an integral part of this agreement. The main terms used herein mean the following:
1. “Store” includes every form of store on the internet, whether an application, a website, or a physical retail location.
2. “Consumer” means the person engaging in e-commerce to obtain products or services offered by the store through its electronic platform.
3. “Agreement” means these terms and conditions, which govern the relationship between the parties.
Article 2 – Legal capacity of the consumer
1. The consumer represents that they have legal capacity to deal with the store under Sharia and applicable law, or that they are at least eighteen (18) years of age.
2. If the consumer breaches this article, they bear the consequences of that breach vis-à-vis third parties.
Article 3 – Nature of obligations
1. The store’s obligation toward consumers is to provide the requested service or product.
2. The store may provide additional services such as after-sales service or other related services, depending on the nature and type of the service or product requested.
Article 4 – Rules of use
1. The consumer must use the store’s electronic platform in a manner consistent with public morals and the laws of the Kingdom of Saudi Arabia.
2. When purchasing a service or product from this store, the consumer must not use that service or product in violation of public morals or the laws of the Kingdom of Saudi Arabia.
Article 5 – Accounts and registration obligations
By applying for membership as a user, you agree to provide certain information and to choose a username and confidential password for accessing the store’s services. By doing so, you agree that:
1. You are responsible for maintaining the confidentiality of your account and password, and you will promptly notify the store of any unauthorized use of your account or any other breach of your confidential information.
2. The store is not liable, under any circumstances, for any direct or indirect, moral or material loss resulting from disclosure of your username or password.
3. You will use your account or membership yourself and remain fully responsible for it; use by another person will be treated as evidence that you authorized them to use the store on your behalf.
4. You will use the store seriously and in good faith.
5. You will provide true, accurate, current, complete, and lawful information about yourself as required during registration and will update your data when it changes or when needed.
6. Our store will handle your personal information and contact details with strict confidentiality.
7. If the store finds that you provided untrue, inaccurate, outdated, incomplete, unlawful, or non-compliant information, it may suspend, freeze, or cancel your membership, store, or account without prejudice to its other rights and lawful means to protect itself and other consumers.
8. Failure to comply with the above entitles store management to suspend or cancel your store or membership or block your access to the store’s services again.
Article 6 – Electronic communications and official channels
1. The parties agree that communication will be via the email registered on the platform.
2. The consumer agrees that agreements, notices, statements, and other communications provided electronically have the same effect as their written counterparts and are admissible for legal and Sharia purposes.
3. The consumer accepts that the store may contact and notify them of provisions of this agreement or matters relating to their dealings by broadcasting general messages to all users or to specific users.
Article 7 – Amendments to the agreement and fees
1. If any article or clause of this agreement is cancelled or ceases to be effective, the remainder of the agreement remains valid until further notice from store management.
2. This agreement, as it may be amended from time to time, constitutes the operating framework and mutual understanding between the consumer and the store.
3. The store may charge fees to some consumers depending on offers, products, services, or government-imposed fees or taxes.
4. The store reserves the right to add, increase, reduce, or discount any fees or charges under this agreement for any consumer, regardless of registration reason.
Article 8 – Payment and settlement services
1. Through its partners, the store provides payment options that may be completed fully online using the methods available on the store or any other method the store may offer from time to time.
2. The store commits to pricing services or products in line with generally accepted market value.
3. The store will provide invoices, receipts, and acknowledgments for amounts and revenue arising in the store and will give the consumer an invoice for the purchased service or product.
4. The store will meet recognized accounting standards in its e-commerce operations as required by this agreement and applicable interests.
Article 9 – Intellectual property
1. The store’s intellectual property rights are owned exclusively by the store, whether acquired before or after launch of this platform.
2. The consumer respects the store’s intellectual property, including the store name, words, logos, and other symbols associated with or displayed by the store; all such rights are the store’s full intellectual property.
Article 10 – Store liability
1. The store will conduct its business on this platform regularly and in accordance with the laws of the Kingdom of Saudi Arabia and this agreement.
2. The store is not liable for claims arising from errors or negligence, whether direct, indirect, incidental, caused by the consumer, or by third parties such as shipping companies.
3. The store, its personnel, owners, and representatives commit that the product or service is sound, lawful, and permitted under the laws of the Kingdom of Saudi Arabia and is used for lawful purposes.
Article 11 – Access or membership restrictions
The store may suspend or cancel a consumer’s membership or restrict access to platform services at any time, without notice, for any reason, and without limitation.
Article 12 – Governing law
This agreement is governed by the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia and is subject entirely to the applicable regulatory framework in the Kingdom.
Article 13 – General provisions
If any article or clause of this agreement is cancelled or ceases to be effective, the remainder remains valid until further notice from store management.
This agreement, as it may be amended from time to time, is the terms of use and the framework for work, understanding, agreement, and contracting between the store and the consumer. The parties also agree that:
1. Arabic is the language used to interpret this agreement or to translate it into another language.
2. All prices for the store’s services or products may change from time to time.
3. Promotional or marketing offers are temporary; the store may change or stop them at any time.
4. The parties will deal with each other in a manner consistent with Sharia, regulations, and laws applicable to their relationship.
5. This agreement may only be cancelled by a decision of store management.
